BUYERS PREMIUM: A 10% Buyers Premium will be added
to the purchase price of each item. SALES TAX: Applicable sales tax collected unless a valid Texas
Resale Certificate is completed and Texas Sales or Use Tax Numbers are
provided. Prospective buyer should present their resale information at the
time of registration. IDENTIFICATION: In order to obtain a bidder number, you must
register giving your full name, street address, telephone and drivers
license number.
DEPOSIT: A refundable deposit may be required to obtain a bidder
number dependent on specific auction. METHODS OF PAYMENT: Cash, Pre-Approved Checks with Bank Letter of Guarantee.
Certain auctions also accept credit cards dependent on type of auction. TIME OF PAYMENT: All merchandise must be paid in full at time and
place of sale, and before items are removed. REMOVAL: All merchandise must be removed by the specified time set
forth by auctioneer.Items must be removed on day of sale.
CONDITION OF ITEMS SOLD: The auctioneer shall not be responsible
for the correct description, authenticity, genuineness of, or defect in
any lot, and makes no warranty in connection therewith. No allowance will
be made or sale set aside on account of any incorrectness, error in
cataloguing, or any imperfection not noted. No deduction will be allowed
on damaged articles as all goods being exposed for public exhibition are
sold "as is" "where is" with no warranty expressed or implied.
BUYER RESPONSIBILITY: Once an item is declared sold, it
becomes the responsibility of the buyer. The auction company will not be
responsible for items lost, stolen, or damaged. PERSONAL AND PROPERTY RISK: Persons attending during Preview,
Sale, or Removal of Goods assume all risks of damage of or loss to person
and property and specifically release the auctioneer from liability
therefore. Neither the auctioneer nor his principal shall be liable by
reason of any defect in or condition of the premises on which the sale is
held. BIDDER DISPUTE: If any dispute arises, auctioneer’s decision shall
be final and absolute. RECORDS: The record of sale kept by the auctioneer and bookkeeper
will be final in the event of any dispute. WITHDRAWAL OF ITEMS: Auction Company has the right to withdraw any
item up for auction at their discretion. SALE BY ESTIMATED WEIGHT, COUNT, OR MEASURE: Where items are sold
by estimated weight, count, or measure, the purchaser will be billed for
and required to pay for the estimated weight, count, or measure. If, upon
delivery, any shortage exists, the purchaser will receive a refund at the
rate of purchase. If there is an excess, the purchaser will be required to
take and pay for such excess, at the rate of purchase. RESERVE: The Auctioneer reserves the right to reject any and all
bids. On lots upon which there is a reserve, the auctioneer shall have the
right to bid on behalf of the seller. RESALE: Auctioneer reserves the right to resell any property not
paid for in full on auction day and/or any items not removed by the
announced removal deadline date. The buyer shall be responsible to the
auctioneers for any expenses of resale, collection, and/or damages
resulting from the resale. CLAIMS: No claims will be allowed after goods are removed from
premises.ANNOUNCEMENTS: Announcements made Auction Day take precedence over
any written or spoken material previously released.
AGENCY: The auctioneer is acting as agent and is not
responsible for acts of its principals.
